STATEMENT BY THE PROFESSORS FOR PEACE CONDEMNING THE RUSSIAN INVASION OF UKRAINE

On 24 February 2022, Russia  invaded Ukraine, signaling a dramatic escalation of conflict between the two nations that began 2014. The human cost of the invasion has already reached over 9000 dead, and at least one million displaced by the fighting. Unless immediately stopped, the war will likely precipitate a humanitarian disaster with millions displaced and tens of thousands killed.

We support the efforts of the Philippines’ Department of Foreign Affairs to secure and repatriate about 300 Filipino citizens and OFWs in Ukraine.

We support the DFA’s statement at the emergency special session of the United Nations General Assembly held on March 2, 2022, joining a growing number of nations calling for an end to hostilities and the protection of civilians and civilian infrastructure. We support efforts now underway in the UN for massive humanitarian assistance for the Ukrainian people, and the promotion of humanitarian principles and international rule of law in addressing this conflict.

We believe to do so is in the enlightened interest of the Philippines and the rest of the world.

First, the war and its repercussions are disrupting and delaying global economic recovery from the coronavirus pandemic. Already, multilateral financial institutions have slashed their economic growth forecasts for the global economy. For the Philippines which is dependent on trade, investments and migrant remittances, slower global growth combined with much higher uncertainty and volatility in international financial markets will diminish the strength and inclusiveness of economic recovery.

Second, the Russian invasion of Ukraine provides a  dangerous precedent that threatens the territorial integrity, political independence and sovereignty of countries with powerful, expansionist neighbors.

Third, a further deterioration of this conflict and a possible wider conflagration in Europe, with risks heightened due to the high alert status of Russia’s nuclear forces, could lead to unfathomable human destruction that will affect us all.

We call on our government to condemn the invasion, and to do what it can to support the people of Ukraine. We stand with the growing number of citizens across the world, and most specially in Russia itself, who demand an end to this military aggression.

Statement on International Rule of Law and Juan Felipe Reef Incident

The incursion into our Exclusive Economic Zone (EEZ) in Julian Felipe reef of over 200 Chinese ships stands as a clear and present threat to the Philippines’ national sovereignty and territorial integrity. The Chinese flotilla’s continued unlawful occupation and quarantining of the area, despite the government’s official protests, directly contravenes international law.

Julian Felipe Reef is near Mischief Reef, which has been illegally claimed by the Chinese, raising further concerns on their behavior in Julian Felipe Reef. International law recognizes Philippine sovereignty over its territorial sea (12 nautical miles) and jurisdiction over its Exclusive Economic Zone (beyond 12 and up to 200 nautical miles). Julian Felipe Reef  is 175 nautical miles from Bataraza, Palawan.

We call on China as a signatory to the United Nations Convention on the Law of the Sea (UNCLOS) to uphold its commitment to the international rule of law.

We support Secretary Lorenzana and our defense establishment in demanding that the Chinese vessels leave our territory immediately. We cannot tolerate the outright theft of our natural resources and the harassment of our fishermen.

We join the overwhelming majority of the Filipino people who have consistently called  for a more decisive foreign policy and national security stance to protect our territory and our people, and to regain lost ground.

We reject the argument that asserting our sovereignty, protecting our fisherfolk and managing and protecting our own natural resources constitutes a declaration of war. We call on our government to look to the concrete examples provided by Vietnam and Indonesia, which have both stood up to China and have taken concrete efforts to counter incursions into their EEZs while maintaining economic ties with China.

We support calls by our scientific and research community to advance proposals such as international scientific cooperation, to help protect our maritime resources and continue asserting our sovereignty in peaceful and constructive ways. And we thank the countries which have expressed support for the principled stand we have taken on this issue; and ask them to help us promote international cooperation initiatives, drawing on development partnerships with ASEAN and other like-minded nations, to protect humanity’s maritime commons and defend them from wanton destruction and over-exploitation.

As a responsible member of the community of nations, the Philippines must pursue peaceful and cooperative options to settle international disputes. But we must surrender neither our territory nor our national self-respect by silently acquiescing to China’s unlawful actions.

NO TO RevGov | Statement on Preserving Constitutional Institutions

We, the undersigned academics, researchers and educators, are gravely alarmed by the recently revived call for a revolutionary government (RevGov).

Last Saturday, August 22, 2020, a manifesto signing was organized that sought to declare a “peaceful and non-violent” revolutionary government to be headed by the President, with the main agenda of shifting to a federal system of government. This is reminiscent of the same call in 2017—yet this time it adds further uncertainty to an environment already racked by the COVID-19 pandemic and the concurrent economic recession.

Legal practitioners and scholars have since warned that a revolutionary government necessarily entails a violation of the Constitution; and any effort to push for such is beyond the permissible bounds of law.

A call for a revolutionary government is no less than a call for the overthrow of the existing constitutionally mandated government, notably all of its democratically elected leaders—President, Vice President, Senators, Congress(wo)men, Governors, Mayors and other officials–and democratic institutions to boot.

We reject calls to declare a revolutionary government.

A revolutionary government poses an existential threat to the democratic processes and institutions of checks and balances enshrined in the 1987 Constitution. Among others, the separation of powers among the Executive, Legislative, and Judiciary, the independent constitutional bodies, and most importantly the Bill of Rights are all at risk under RevGov.

Even if it were well-intentioned, RevGov is a short cut whose end (federalism) cannot be used to justify the means. It will consolidate power to a few with no assurance of accountability.

Further, if  a Philippine President supports the installation of a RevGov and heads it,  she or he is deemed to have resigned from the Presidency under the Constitution, in which case the constitutional succession under Section 8, Article VII of the 1987 Constitution that “[i]n case of death, permanent disability, removal from office, or resignation of the President, the Vice-President shall become the President to serve the unexpired term”, must become operational.

We condemn all proposals that undermine the Constitution, its processes, and its institutions.

We support the leadership of the Armed Forces of the Philippines, Philippine National Police and the Department of National Defense for swiftly and unequivocally rejecting RevGov, staying true to their Constitutional mandate as protectors of our democracy and the people. We appeal to the rest of the government and its officials to refrain from entertaining calls to declare a revolutionary government.

Aside from its unconstitutionality, we are reminded of the fact that the country is still facing a pandemic – with more than 200,000 confirmed cases and 3,000 deaths. The call for RevGov is a divisive distraction to the President’s own call for a more successful whole-of-society response to the pandemic. The Filipino people need the government’s undivided dedication in responding to the COVID-19 crisis and the economic recession; and the nation needs a unified response against the clear and present danger that is COVID-19.

NO TO CON-ASS | Statement on Prospect for Constitutional Reforms

We, the undersigned academics and professionals, are expressing our deep concern as regards the process of reviewing and possibly amending our Constitution.

We acknowledge the importance of discussing ways to improve governance in the country, particularly when it comes to a possible shift to a new, federal form of government. Some of us actually support federalism, while others oppose it. We have nevertheless united in this common statement to acknowledge the importance of evidence-based debate and discussion to root out the main benefits and costs of such a reform.

Given the far-reaching implications of this reform, we believe the process must be much more participatory—including not just those who are for this reform, but also those who oppose it. International policy experience and evidence suggests that constitutional reforms are more effective if deliberations are front-loaded at the crafting stage, rather than belatedly appended once these reforms are already ratified.

The present environment is not conducive to reforming the constitution. The most recent nationwide surveys of SWS and Pulse Asia last March 2018 show that only 25% of our citizens sufficiently understand our existing constitution, while only 37% support the shift to federalism. 64% are against charter change. ‘Changing the Constitution’ also ranked last in the ‘most urgent national concerns’ with only 3% of the Filipinos saying that it should be acted upon immediately.

We do not support calls to channel this reform through a Constituent Assembly.

Almost 80% of Congress is comprised of political dynasties, and the empirical evidence suggests that a majority of them may face deep conflict of interest if a new constitution aims for reforms that level the political playing field. The risk of capture by vested interests affecting our present politics is too great.

We do not support calls to postpone or cancel elections in 2019.

Finally, we believe that there are more pressing and immediate policy challenges that our leaders must address. The rising death toll linked to the anti-drugs campaign, which now includes many children and young people. The killings of political leaders and priests also further raise the spectre of injustice. Rising prices of basic commodities, transportation and other needs are also hitting the poor, our workers, and millions of low income households. If these are unresolved, then how can we credibly unite around “rule of law” and “human rights” under an amended constitution?

A constitution is supposed to bind our nation in common values and a shared vision. It is the very glue that should unite us all in common purpose. If we are to amend the constitution, we must invest not just in the outcome, but in the very process.

This is a broad discussion that must bring together our citizens from all walks of life, professions and political leanings. It is a national discourse that must allay fears, clarify concerns and bring us all towards common ground.

STATEMENT CALLING FOR A SENATE INVESTIGATION INTO THE DEATH OF KIAN LOYD DELOS SANTOS AND OVERHAUL OF THE GOVERNMENT’S ANTI-DRUGS CAMPAIGN

We, the undersigned academics, teachers, analysts and researchers are issuing this joint statement to call on the Senate to open an investigation into the death of seventeen-year-old Grade 11 student Kian Loyd Delos Santos.

Kian Loyd is among a growing number of children and youth who have been killed as a result of the government’s anti-drugs campaign. The long and still growing list includes 4-year-old Althea Barbon of Negros Occidental, and two 5-year-old children–Danica May Garcia, an honor student from Pangasinan, as well as Francisco Manosca, who was gunned down with his father in Pasay City.

Whether killed by police, or murdered, allegedly, by unknown assailants, the senseless deaths of so many of our youth and thousands of our citizens are a signal of the worsening environment of violence and lawlessness that now threatens the very communities that the anti-drugs campaign was supposed to protect.

We are deeply alarmed by the growing divide within communities as Barangay leaders are asked to draw up lists of suspected drugs affected citizens who are then identified, rounded up, and in many cases later killed in either police operations or by unknown assailants.

We also note the evidence of continuous influx of illegal drugs into the country, notably from China. We are alarmed that too much attention has been given to punishing small-time drug users and pushers, but little has been done to prevent big-time drug smugglers from continuing to flood the country with illegal drugs.

We call on the Senate to investigate and consider the urgent need for a complete overhaul of the government’s anti-drugs campaign. Any such campaign should protect instead of harm our children and youth, include target interventions on the main sources of drugs, and value the rights of all Filipino citizens under a strong rule of law.

We recommend alternative and more evidence based strategies and policies to combat drugs. We urge government to place a greater focus on the root causes of drug use, the root sources of drug supply in the country, and the root issues of poverty and corruption that have aggravated the drug problem.

We emphasize, in particular the need for nonviolent, humane, holistic, health-based and community-based approaches to address drug addiction, as well as information and education campaigns to protect young people from falling prey to the menace of drug addiction.

We urge everyone not to forget the main reason why the country needed an anti-drugs campaign in the first place – to protect our citizens, particularly our children and youth, from harm.
